The Employers’ Association (TEA) is hosting a half-day program consisting of three sections. The three sections follow one case study through different circumstances and explores what can be done in each situation. This program will be presented by Kelly Petrocelli, Rhoades McKee Labor and Employment Attorney.

Section 1 – Exploring Issues Confronting Employers under the FMLA

This section will provide HR professionals with a foundational understanding of employer obligations under the Family and Medical Leave Act. Using a case study format, attendees will learn how to identify and appropriately respond to requests for FMLA leave. It will challenge HR professionals to apply the FMLA in a variety of situations, including recertification of intermittent leave, seeking second opinions, and incomplete medical certifications.

Section 2 – Exploring Issues Confronting Employers under the ADA

This section will explore the complex issues that arise when providing or responding to requests for accommodation under the Americans with Disabilities Act (ADA). Again, using the case study format, we will discuss the different types of accommodations available under the ADA, including reassignment, and how to engage in and document the interactive process with an employee who has requested an accommodation.

Section 3 – Exploring Issues Confronting Employers under the ADA and GINA

In this portion, we will explore other employer obligations under the ADA, including maintaining the confidentiality of employee medical records, the statutory limits placed on disability-related questions and medical exams, and fitness for duty exams. We will also provide HR professionals with a basic understanding of the Genetic Information Nondiscrimination Act (GINA) and how that statute and the ADA intersect, including in the area of pre-employment, post-offer medical exams.

 

This program has been approved for 2.00 (HR (General)) recertification credit hours toward PHR, SPHR and GPHR recertification through the HR Certification Institute.
